Page 3 of 4 4)." Our general reading of the progress of the case itself was tiresome in the extreme. There were enough motions, declarations, and responses in this case to make our eyes cramp. Nonetheless, our general take on the progression of the case indicates to us that many of the tactics of the plaintiff involved outmaneuvering the discovery process through careful obfuscation and procedural rigmarole. We found this one in particular worthy of performance as a high wire act in Cirque Du Soleil. Do you feel the gist of your defense fell victim more to procedure than fact?"
"To be honest, I would love to comment on what could
have happened and what should have happened, but that’s neither here nor
there. What’s done is done and I now
need to focus on what’s planned for the future.
Yes, there was ample procedure thrown at my attorney and me during this
defense, more than you might see in some other cases, but we cannot change the
past. We can only go forward with what
experiences we have learned from the case and use that knowledge to our
benefit." "I am very optimistic with how the case is proceeding forward. There are many avenues we can utilize which have the potential to give us a better outcome than before." 6). "Do you have any advice for our readers based on your experience with the issues involved?" "My advice to readers, especially those who find themselves in similar circumstances to mine, is to fight back. The recording labels are suing people on a flawed, corruptible technology in an attempt to save a dying business model. This is by no means how business should work and the more vocal these victims become, the more aware the public will remain and these same companies will realize they need to choose another path. There are studies recently conducted showing the very reason these companies are suing, which is illegal file sharing over peer to peer networks, doesn’t in fact hurt record sales, but actually helps boost sales." 7). "Any closing comments? Anything to get off our chest?" "The only thing I have to personally say is no matter how negatively the Plaintiffs attempt to paint me in this situation, no matter how many derogatory names, personal insults or unflattering comments they fling in my direction, I am not going anywhere. My attorney, Mr. Toder, said it best when he said “we will be their worst nightmare.” ... We would like to thank Jammie Thomas for kindly extending us the opportunity to speak with her. We maintain that we hold no ill will towards the RIAA and the plaintiffs. We do personally wish Ms. Thomas the best in resolving her situation in a favorable manner. Insofar as the RIAA and the remaining plaintiffs are concerned, we wish them the best as well, while asserting our opinion that they need to find better things to do with their spare time. For instance, getting back to the business of selling music in a manner consumers will accept, and perhaps hiring people more in tune with society would be more productive activities. |
